S. Mark Klyza is an attorney with The Kullman Firm. The Kullman Firm is a law firm that specializes in labor and employment law. In my personal opinion, though, I consider Mr. Klyza's actions to be unprofessional and a violation of the Rules of Professional Conduct. I understand that as the attorney for Terrebonne General Medical Center that The Kullman Firm has to do the legal dirty work for them. However, there are rules and moral principles attorneys must follow, which it seems Mr. S. Mark Klyza has swept under the rug.
I understand that an attorney is to speak on behalf of their client. In this situation, though, I feel that Mr. Klyza went beyond speaking on behalf of his client and sped straight in to bullying and violated the Rules of Professional Conduct. Mr. S. Mark Klyza violated the Rules of Professional Conduct when he threatened legal action when there was no legal merit to do so. In addition, Mr. Klyza sent a copy of the letter to law enforcement officials (Terrebonne Parish and St. Mary Parish Sheriff's Office). Mr. Klyza is an attorney, which is considered to be a professional that is honest and to present the truth. Therefore, when he sent a copy of that letter to the Sheriff's Offices, he was stating that the information contained within the letter was material fact. He completely failed to present to the Sheriff's Offices all of the facts of the matter. Most notably would have been that Ms. Peoples never did request that I no longer contact her, therefore, there was no grounds for harassment.
I did file a complaint with the Louisiana Attorney Disciplinary Board (view letter), however, their decision (based upon Mr. James T. Daly), is that the letter "expresses wishes and opinions on behalf of his client" (view response). I cannot believe that the board allows such unethical and immoral acts as Mr. Klyza has done. I will continue to pursue this matter as I will be forwarding this matter to the Administration of the Louisiana Attorney Disciplinary Board.
With all of Mr. Klyza's education and experience (i.e. serving on staff of the U.S. Department of Labor in Washington, D.C.). I do hope that people read this website and see the true nature of Mr. S. Mark Klyza and The Kullman Firm. In my opinion, Mr. Klyza nor The Kullman Firm have no intentions of finding out the truth. Their only goal seems to be intimidating employees and those that they feel their scare tactics will work on.
