The Whole Truth
My time at Terrebonne General Medical Center was not exactly a pleasant one. My employment at Terrebonne General was terminated on January 2, 2006. The main reason I was terminated was based upon false allegations that Terrebonne General, John Ford (former Human Resources Director), and Phyllis Peoples (President and CEO), failed and refused to properly investigate. The details of this was submitted to Phyllis Peoples in a letter (read the letter here). Initially, I had sent two emails to Phyllis Peoples. The emails were basically the same thing that is in the letter I sent her via postal mail. I had sent the emails about a month or so apart with return receipt request. I never received a response from the emails. I did not know whether Ms. Peoples received the emails or not. After sending the letter to Phyllis Peoples, I received a letter from her a couple of weeks later. Her response seemed to be very nonchalant and insincere. I was very shocked at Ms. People's insincere response. After what I was accused of and what I had gone through (being escorted off the property as if I was some terrorist), I had expected a more active response. I expected a response that she would look in to the matter. It was stated by Terrebonne General Medical Center that an ER Tech told two nurses (Carla Edgar, RN and Cheryl Dufrene, RN) that I told him, "One day I'm going to come in here and shoot everybody one by one." I wanted to know what was going on. I felt that I had the right to know what happened. However, it seemed as if Phyllis Peoples was stonewalling me and trying to just brush me off. So, I sent her a response expressing my dissatisfaction with how she failed and refused to handle the matter. I notified her (view letter here) that the matter was being published online so that people could be warned of Terrebonne General's use of scare tactics.
As usual, Ms. Peoples employed scare tactics. It seems that is how TGMC operates. If you are not part of a clique and your opinion differs from theirs, then they seem to use scare tactics as a force to silence you. In this case, Ms. Peoples decided to have the law firm representing Terrebonne General (The Kullman Firm) send out a threatening letter. You can view that threatening letter here. As you can see, Phyllis Peoples accuses me to harassing her as well as making slanderous and libelous statements. There are a couple of statements I made in the online post. The statements were in regards to Terrebonne General infecting a patient with Hepatitis C as well as Terrebonne General's conspiring against another local home health agency. Was this slander? Not in the least. The post contained links to the actual court documents where Terrebonne General was sued. You can read the documents for yourself.

To add to the use of scare tactics, it seems that The Kullman Firm sent a carbon copy of the letter to the St. Mary Parish and the Terrebonne Parish Sheriff's Office. Unfortunately for Phyllis Peoples and the bullying law firm, The Kullman Firm, the letter did not scare nor intimidate me in the least bit. There were no grounds for harassment as Phyllis Peoples never stated that she wanted me to cease and desist communications with her. In addition, Phyllis Peoples never stated that she did not want to discuss the matter. Granted, the tone of her letter was evasive, however, she never directly stated nor directly implied a cease and desist of communications.
In the end, it seems as if I am banned from Terrebonne General Medical Center. I sent a letter to Mr. S. Mark Klyza asking if it were possible for me to visit Terrebonne General Medical Center if a friend or family member were to be hospitalized there (view letter). I was told to contact the Human Resources department (view The Kullman Firm's response). I think that it's pretty sad that I am banned from a hospital because of false accusations as well as the pride, attitude, and incompetence of the CEO, Phyllis Peoples. It seems she will stop at nothing to ensure that her rein of tyranny and scare tactics are known to those that oppose her. I responded to the letter I received from The Kullman Firm (view letter). I let them know that I was not afraid of their scare tactics and that I would not stop publishing the truth about Phyllis Peoples and Terrebonne General Medical Center.
I felt that by Mr. S. Mark Klyza sending carbon copies of that letter to the Sheriff's Office, Mr. Klyza and the firm were violating the Rules of Professional Conduct as set forth by the Louisiana Bar Association. The Kullman Firm claims to be experts in the field of labor and employment law. It seems to be that their expertise is in bullying and pushing little guys around. It seems to me that their "expertise" is being the big bully for corporate businesses to try and use scare tactics against the underdog (i.e. the average working employee). Their scare tactics was quite evident in the letter they typed up for Phyllis Peoples. I did respond to their letter, though. I let them know that I would not back down from exposing the truth about Phyllis Peoples, Terrebonne General Medical Center, and their unscrupulous acts. I filed a
complaint with the Louisiana Bar Association's Disciplinary Board as I felt that
Mr. S. Mark Klyza violated four provisions of the Rules of Professional Conduct.
You can view the letter I filed here. Unfortunately, the Louisiana Bar Association sees
nothing wrong with what Mr. Klyza done, even though in my opinion, Mr. Klyza
clearly violated the Rules of Professional Conduct (view Louisiana Bar
Association's response). I do have plans of contacting the the
administration of the Louisiana Bar Association Disciplinary Board. I feel that
Mr. James T. Daly (Screening Counsel), did not adequately evaluate my complaint.
It is a shame that Mr. Daly so easily dismissed Mr. Klyza's unethical and
bullying tactics. I can understand that an attorney has to be aggressive in
defending their client, however, when Mr. Klyza forwarded that letter to the
Sheriff's Office, he violated Rule 4.1 by making a "...a false statement of
material fact or law to a third person." In addition, as part of Rule 4.1 he
failed to "...disclose a material fact when disclosure is necessary to avoid
assisting
a criminal or fraudulent act by a client, unless disclosure is
prohibited by Rule 1.6."
In addition, I have filed a complaint with the Louisiana Board of Nursing. The two individuals that were mentioned in the rebuttal letter that the Louisiana Department of Labor received from Terrebonne General stated that Cheryl Dufrene, RN and Carla Edgar, RN are the ones that passed this false information on to administration. I sent the letter on July 25, 2007. I have yet to receive a response as to whether the matter is being investigated. If Cheryl Dufrene and Carla Edgar did tell administration this lie, then I feel they should have their nursing licenses revoked. You can view the complaint I sent here.
There is one piece of evidence I do not have available. When I filed for unemployment Terrebonne General Medical Center filed a rebuttal to my claim. In the claim it mentioned the ER tech and the two nurses that allegedly made the false statements. Despite my requests to the Louisiana Department of Labor for a copy of the rebuttal letter, I have been denied. You can view a copy of the letter I sent Mr. Peter Wright (Legal Division) of the Louisiana Department of Labor here. I did not receive a denial letter. Mr. Wright called me to inform me that he could not provide me a copy of the letter because of "privacy issues."
Do I believe there's some conspiracy going on between Phyllis Peoples, Terrebonne General Medical Center, and so forth? No. What I believe is that Phyllis Peoples is used to pushing people around with scare tactics utilizing her attorney, Mr. S. Mark Klyza. In addition, I feel that the individual that received my complaint in regards to Mr. Klyza's unethical actions did not properly evaluate the situation. It is for this reason that I have created this website. So that people can see what types of unethical actions are going on, to see how complaints are not being properly handled. Instead of creating some website that mentions these issues, I have also provided the actual evidence so that you can see and judge these matters for yourself.
This website will stay up for as long as I can keep it up. I don't doubt that Ms. Peoples and her attorneys will try their best to get it shut down. In return, I will do my best to keep it up and running. If you have any questions, feel free to contact me.
